FOR IMMIGRANT INVESTORS · BELLEVILLEBelleville

Invest in anew chapter.

Suppose a Belleville investor is considering a regional-centre partnership in which they will not manage day-to-day operations. EB-5 still requires the investor’s qualifying engagement in management, which can include permitted policy-formulation participation under the applicable framework. Review the actual rights rather than assuming every passive label qualifies or that every investor must supervise employees personally. Start with the signed rights, traceable capital path, and job methodology rather than an offering label. Participation, at-risk terms, employment creation, and the later conditional-residence stage need separate review. EB-5 requires qualifying capital exposed to risk and the required employment creation under the applicable framework. Residence begins conditionally, so removing conditions later calls for separate evidence. A disciplined review treats project documents as continuing evidence rather than a single filing package. It should identify the capital source, investment terms, job method, investor rights, and reports needed to follow performance. That enables an informed decision about immigration conditions and commercial exposure. It also makes clear that an attractive redemption discussion cannot substitute for money remaining exposed to business outcomes while the applicable requirements apply. The investor should know which reports or amendments need prompt review during the conditional period.

01

Read the investor’s rights

Identify the partnership or enterprise provisions governing participation, policy and decisions. The applicable rules may recognize qualifying limited-partner rights, but the signed arrangement must support the case. A marketing statement that no involvement is needed should not replace the legal documents. Make a rights chart for voting, information, removal, and policy provisions in the acquired class. Signed documents, not a marketing summary, settle the participation question.

02

Review the capital and job requirements

Establish the applicable qualifying investment and at least ten full-time jobs for qualifying U.S. workers per investor under the permitted framework. As of September 8, 2026, the statutory thresholds are US$1,050,000 standard or US$800,000 for a qualifying targeted employment area or infrastructure project. Because statutory adjustment begins January 1, 2027, verify the amount current on the filing date. Use a capital-and-jobs worksheet that separates investment from charges and explains the job methodology. A total on a spreadsheet does not establish the underlying inputs.

03

Trace the lawful contribution

Document source and path and distinguish actual capital from separate charges and future promises. A limited operational role does not remove financial evidence requirements. Investment must satisfy the at-risk and other conditions; repayment is not guaranteed by the programme. Trace sales, gifts, loans, or transfers through contemporaneous records. A final bank balance cannot explain the lawful path or a term that reduces commercial risk.

04

Understand the case beyond subscription

The investor petition, residence process and later removal of conditions are distinct steps. Admissibility, visa availability and family eligibility need attention. Signing partnership documents does not itself grant work permission or permanent residence. Maintain a process calendar for the petition, visa or adjustment steps, conditional residence, and the later I-829 period. Family eligibility and visa availability can alter practical timing.

05

Calendar residence obligations separately from partnership terms

Statutory investment adjustments begin January 1, 2027, which calls for checking the amount applicable to the filing. EB-5 permanent residence is conditional for two years; Form I-829 generally must be filed within the 90 days before its second anniversary. A partnership agreement cannot change that immigration window, and submitting the petition does not automatically remove conditions or require repayment. For amendments, record what changed and whether it affects capital deployment, rights, or job evidence. Early approval does not freeze later business decisions for immigration purposes.
