PROGRAMME BRIEFING · BELLEVILLEBelleville

A new route.Know the details.

Hypothetical example: a Belleville applicant wants to pursue the individual Gold Card route while continuing to live outside the United States. Existing US status is not a universal prerequisite to applying from abroad, but the applicant still needs the appropriate immigrant process and eligibility review. Gold Card is not a conventional visa category and its government gift is not an EB-5 investment. Reverify the official terms before any money moves; a pending application or gift does not authorize an early move or US employment. Map the immigrant basis, admissibility history, visa availability, family composition, and current location before treating payment as the central issue. Official instructions, rather than private marketing, determine when and where a payment is made. The Gold Card is never a conventional visa. The applicant makes the required payment to the U.S. government through the official process; that payment does not buy equity or permit early U.S. work. The initial decision record should distinguish an official government instruction from an agent's proposal and preserve the applicant's proof of the underlying immigrant basis. It should name each family member expected to join, their relationship evidence, and the intended sequence of processing. That separation prevents a payment discussion from obscuring admissibility, visa availability, or the procedure for someone outside the United States. Any private service provider should be assessed separately from the official gift payment, and no one should treat a pending request as travel or work authority. Before any payment discussion, the applicant should decide whether the evidence for the underlying immigrant category is mature enough for the intended route. The answer should be documented separately from financial capacity, because a complete budget cannot cure an unresolved eligibility or admissibility issue.

01

Identify the applicable process

Establish the applicant’s actual location, status history and intended route to residence. Do not assume adjustment of status is available to someone simply because they have paid. A case from abroad has the relevant visa and admission steps in addition to the programme’s requirements. A chronology of U.S. visits, status history, and current residence helps distinguish procedural options from assumptions. A past visit for one purpose does not determine an immigrant case.

02

Review eligibility before payment

Gold Card is not a conventional standalone visa category. Under the current official framework, it uses a gift to the U.S. government plus a processing fee within an EB-1 or EB-2 immigrant process; the gift is not an EB-5 investment. Applicable criteria, admissibility, and visa availability still matter. Re-verify the current official terms before any money moves. Assess the EB-1 or EB-2 basis from its own evidence. The payment framework does not waive admissibility or create eligibility for an underlying classification.

03

Calculate the individual household

The stated individual gift is US$1 million with a US$15,000 non-refundable processing fee per person. Each eligible joining spouse or child adds the same amounts. The gift follows vetting when instructed; other visa, medical and professional expenses can be additional. Build a household budget that separates the processing charge, gift payment, family amounts, and other costs. Retain official instructions and payment confirmation.

04

Separate temporary travel from immigration

Any proposed visit while a case is pending needs its own assessment of purpose and eligibility. A pending immigrant plan can be relevant to temporary entry even though it does not itself grant status. Do not describe a visit as a way to begin the permanent move before permission exists. Assess temporary travel by actual purpose and duration. A visitor plan cannot be used to begin the intended permanent relocation or employment.
