Public availability is not an automatic answer to the specialized-knowledge analysis. Assess the knowledge actually claimed, the applicant’s depth of expertise and the applicable special or advanced standard. Explain the gap between reading and applying
Identify the judgments, configurations or procedures the applicant has mastered and show their relevant experience. Avoid claiming that all public knowledge is ordinary or that an unpublished detail necessarily qualifies. The US assignment must actually call for the expertise described.
Begin with foreign employment records, training, project history, related-company proof, and the proposed U.S. assignment. The first review should produce a knowledge-to-duty chart explaining what the person knows, how it was learned, and why the U.S. work needs it.; each conclusion should point to the record that settles it. Next, establish corporate and employment facts before arguing about rarity. This order keeps a later explanation from being asked to repair a missing fact. What commonly goes wrong is a confidentiality agreement may show secrecy without proving developed expertise. Preserve dated source material and identify the unresolved issue instead of using a confident generalization. Hypothetical example: A water-treatment analyst has tuned sensor thresholds across installations and will stabilize a new U.S. line. The review identifies the diagnostic judgment, its source records, and the U.S. task. The decision is whether the actual record supports the proposed activity now, requires a different sequence, or calls for a separate route. L-1B likewise requires related qualifying organizations and twelve uninterrupted months of full-time foreign service in the preceding three years. Total time in this classification is generally capped at five years.
