Can my spouse serve on the US company’s board while holding L dependent status?

THE DIRECT ANSWER

Review the actual activities and work permission rather than deciding from the board title alone. Qualifying L spouses may be employment-authorized incident to status with the required evidence, but a pending principal case does not grant that status. Ownership, governance and employment questions should be assessed on their facts.

Describe the intended participation

Identify duties, compensation and where activities will be performed. Confirm the spouse’s status documents before any work requiring authorization. Do not assume an unpaid directorship is automatically permissible or that a family business relationship extends the principal’s authorization.

Begin with each relative's identity and relationship evidence, planned activity, and any independent professional plan. The first review should produce a family-status checklist kept separate from the principal's company evidence.; each conclusion should point to the record that settles it. Next, confirm admission documentation before an adult starts paid activity. This order keeps a later explanation from being asked to repair a missing fact. What commonly goes wrong is a family link to the company does not enlarge the principal's status. Preserve dated source material and identify the unresolved issue instead of using a confident generalization. Hypothetical example: An occupational-health consultant accompanies a transferee and is invited to lead paid workshops for the affiliate. The review treats the workshops as the consultant's own permission question. The decision is whether the actual record supports the proposed activity now, requires a different sequence, or calls for a separate route. L-1A also requires qualifying related companies and twelve uninterrupted months of full-time qualifying foreign service during the preceding three years. The aggregate L-1A period is generally capped at seven years.
