Explain executive authority and operating support in the new office

USAvisa field guide · 3 minute readReviewed 7 September 2026
THE SHORT ANSWER

A new US operation may appoint an executive who reports to a board while the initial team is still forming. The L-1A plan should show the real delegated authority and how operational tasks will be handled. A senior appointment alone does not establish the qualifying role. A new-office plan must be commercially credible and precise about the transferee's role. Identify secured premises, ownership, foreign service, funding, hiring, and the work that will be delegated as the U.S. operation develops. Hypothetical example: A laboratory-supply company leases a warehouse and wants to transfer its foreign operations director, who will set up vendors and hire staff. The company must decide whether the first-year plan shows that the role will become primarily managerial or executive. L-1A requires a qualifying organization and a continuous full-time qualifying year abroad during the prior three-year period; total L-1A stay is generally limited to seven years. Before filing, test whether the first-year evidence is realistic about staffing, revenue, premises, and duties. The company must decide whether it can support the required role on the documented plan, not whether it can describe an aspirational chart. The company should decide whether its forecast is supported by records it can produce now, including premises, funds, staffing, and workflow. A proposed future structure is useful only when it credibly explains how the qualifying role will be supported.

01

Establish the office and relationship

Determine when the US operation began doing business and whether new-office rules apply. Support the qualifying corporate relationship and foreign employment. Incorporation and a board resolution prove different facts from actual operations. The concrete decision is whether the U.S. operation is a new office and can support the proposed role. The first review should identify the record owner, the next step, and the consequence of leaving the point unresolved.

02

Describe decisions and implementation

Identify the executive’s authority and any reserved board matters accurately. Explain who carries out daily work and how the office will support qualifying duties within the applicable period. Do not invent staff or unlimited authority to make the chart look complete. Treat incorporation, lease, and doing business as distinct facts. The first review should identify the record owner, the next step, and the consequence of leaving the point unresolved.

03

Track the business as it develops

Preserve records of hiring, contracts, finances and duties. Review meaningful changes instead of continuing to rely on an outdated launch plan. Initial approval does not guarantee extension or remove later evidentiary requirements. Preserve original plans and later operating records for any extension review. The first review should identify the record owner, the next step, and the consequence of leaving the point unresolved.
