Choosing a category by what the second adult may do: a Tyendinaga household

THE SHORT ANSWER

Hypothetical example: in a Tyendinaga household, either adult could be the principal applicant. One is a veterinarian who could pursue a professional classification; the other manages operations at a manufacturer with an American affiliate and could be transferred. The categories differ sharply in what they permit the accompanying spouse to do, and for a household that needs two incomes that difference is often the most important fact in the decision. Hypothetical example: a Tyendinaga household has one adult offered a transfer, a spouse with a U.S. job prospect, and a child whose twenty-first birthday falls during the expected move. The decision is not simply who becomes principal applicant. It is whether every family member has status and work or study permission for the dates that matter.

01

The three dependent positions are not alike

A dependant accompanying a professional in the TN category may live in the United States and may study, but has no employment authorization at all and cannot apply for it. A spouse accompanying an intracompany transferee in L-2 status is employment-authorized incident to that status. A spouse accompanying a treaty investor is likewise employment-authorized incident to status. Children in each of these dependent categories may study but may not work, and dependent status ends at twenty-one in each. Those differences are structural, not procedural, and no amount of preparation changes them. Create a family timeline with passport expiry, birthdays, marriage plans, school terms, and proposed travel. This brings derivative-age issues into view while alternatives can still be considered instead of during a rushed extension or departure.

02

Run the household arithmetic before choosing

Write out both scenarios with real numbers. In the first, the veterinarian is the principal and the other adult cannot work, so the household lives on one income plus whatever Canadian income survives the move, and the second adult's career pauses for the length of the stay. In the second, the manager is the principal, the veterinarian is employment-authorized as a spouse, and she can seek American veterinary work subject to state licensing, which is a separate and slower gate. The second scenario often produces a materially different household budget, and it may take longer to arrange. Treat work authorization as person-specific. A spouse’s permission under one dependant category does not automatically transfer to another, and a child's right to attend school is not an open permission to work. Verify the actual classification before accepting employment.

03

Weigh the other consequences, not only the income

Work authorization is not the only variable. The categories differ in duration and renewal, in whether an accompanying adult's status depends on the marriage continuing, in the maximum period available, and in how each relates to any longer-term plan. A professional classification renewable in three-year periods, a transfer classification capped at five or seven years, and an investor classification renewable while the business qualifies all point to different futures. Decide with those in view, and revisit the decision if the household's circumstances change, since the choice made at the start shapes what is possible later. Keep civil documents in a secure, current file. Birth, marriage, divorce, custody, and name-change records can be as important as the principal applicant's employment documents. An inconsistency that seems minor in Canada can delay a family application.
