FOR SPECIALIST TEAMS · TYENDINAGATyendinaga

Your expertise.Across borders.

Hypothetical example: a Tyendinaga manufacturer of livestock ventilation and barn-climate systems has a small American subsidiary that sells and installs its equipment. Its applications specialist designs airflow layouts using the company's own modelling software and commissions the controls on site. The subsidiary wants him. Before anything is drafted, the company should describe the American position honestly, because a specialized-knowledge petition fails just as easily on the role offered as on the knowledge held: the job in the United States has to be a job that requires what he knows. Hypothetical example: a Tyendinaga producer of theatre-control software plans to move the engineer who designed its cue-synchronization rules to support a U.S. affiliate. The decision is whether the engineer's knowledge is both company-specific and meaningfully different from ordinary industry skill. A feature list alone is weak; training records, controlled manuals, and evidence of why other staff cannot readily reproduce the work are more useful.

Start with the L-1B eligibility and application overview

01

Define the knowledge, then the position

Specialized knowledge is knowledge of the petitioner's own product, service, equipment, techniques or procedures, or an advanced level of knowledge of its processes. Modelling barn airflow with the company's proprietary software and commissioning its controllers qualifies as knowledge of the product. The second half of the analysis is the American role: if the subsidiary genuinely needs someone to design layouts and commission systems, the position requires the knowledge. If it mainly needs installers and this specialist is simply available, the petition describes something the work will not support.

02

Explain how the knowledge was built

Set out the period over which he acquired it, the internal training the company gave, the projects he has completed, and what a newly hired engineer would need before working unsupervised. Where the company has documentation he wrote, or a design library he maintains, identify it with dates. This kind of concrete history is what separates knowledge belonging to the employer from competence belonging to the profession, which is the line the category draws, and it is far more useful in a petition than an assertion that he is highly regarded.

03

Handle any customer-site work carefully

Commissioning happens at customers' barns, so some of the work will be performed away from the subsidiary's premises. That is ordinary in this industry, but where an employee will be stationed principally at another employer's worksite the arrangement must not amount to placing labour for hire, and the petitioner must keep control of the work through supervision, direction, evaluation and the terms of employment. Describe the pattern accurately: whose projects these are, who directs him, and that customers are buying installed systems rather than a technician's time.

04

Plan around the five-year ceiling

A qualifying parent, branch, subsidiary or affiliate relationship must connect the entities, and the petitioner must be doing business in the United States and at least one other country through the qualifying organization for the duration of the transfer. Time in this classification is limited to five years, with prior L or H time generally counting toward it. Companies frequently spend the first two years using a specialist to deliver projects and only then think about the future. If the role is likely to grow into managing an American engineering or service team, note that a managerial or executive position is a different classification with its own requirements and a longer maximum, and that changing between them requires a new petition and evidence of the new role rather than a change of job title. Build the knowledge record before selecting an assignee. Name the proprietary processes, identify where they are documented, show how access is limited, and explain the operational consequence of losing the person for the assignment. The qualifying foreign employment must total one continuous year within the preceding three years. Specialized-knowledge stays are limited to five years, so the business should also decide whether the assignment has a defined endpoint or needs another long-term workforce plan.
