Read the general immigrant investor briefing overview
Hypothetical example: a Prince Edward County software architect receives a lump sum from the sale of equity in a former employer and asks which of the two routes is faster. Compared properly, they are not two versions of the same thing. EB-5 is a defined immigrant process with petitions, a conditional period and a final filing to remove conditions. The Gold Card is a recent framework whose published terms rest on a gift to the U.S. government and a processing fee, and those terms should be read on the official page before any comparison is attempted. Hypothetical example: a scientific-instrument distributor can either place capital into a qualifying project or make the Gold Card payment, but needs part of the money for a child's education. The concrete decision is whether the household can accept the different loss, return, job, and residence consequences. Write two separate cash-flow models: one for capital remaining commercially at risk through the required period, and one for a payment by the applicant to the U.S. government that is not recoverable. A headline price comparison hides the essential difference.
The EB-5 sequence, step by step
An EB-5 case begins with a petition supported by evidence of qualifying capital, currently 1,050,000 US dollars or 800,000 for a targeted employment area or infrastructure project under the 2022 legislation, subject to adjustment and to be confirmed at the time. It must show the lawful source and path of the funds, at least ten full-time jobs for qualifying US workers attributable to the investment, and the investor's engagement in management or policy formulation. Approval leads to conditional permanent residence for two years for the investor, spouse and unmarried children under twenty-one, ending in Form I-829 to remove conditions. Decide whether the investor can document the source and path of funds, sustain the capital at risk, and meet the job requirement. Those questions remain material after the initial filing and during conditional residence.
What the Gold Card framework actually describes
The official program materials describe a payment consisting of a gift to the U.S. government together with a processing fee. It is not a conventional visa category, there is no investment placed at risk in an enterprise, no job-creation requirement of the EB-5 kind, and no returned capital. Because the framework is recent, the amounts, eligibility and procedures should be re-verified on the official page and in the establishing executive action immediately before any decision, and no intermediary's summary should be relied on in their place. Related government filing fees appear in the USCIS fee schedule. Hypothetical example: a corporation offers to pay for an executive but wants a replacement if she leaves. Decide only from current official terms whether that arrangement is available, and retain the applicant-specific eligibility evidence separately.
Compare them on the questions that actually differ
Three differences drive most decisions. First, the money: EB-5 capital is an investment that can be lost commercially and, in principle, returned; a gift is gone. Second, the obligations: EB-5 imposes continuing requirements through the conditional period and a further filing, while the other framework's ongoing obligations should be read from its own terms. Third, certainty: EB-5 is long-established with published processing information, whereas a recent program's practice is still settling. A reader with liquid funds and no urgency loses nothing by understanding both properly before moving any money, and should write down what the household actually wants from the outcome before comparing prices. Compare the routes only after listing family timing, liquidity, commercial risk, and remaining immigrant criteria. The decision is not between two versions of a visa: Gold Card is never a conventional visa category.
