Start with the TN eligibility and application overview
Choose the alternative before the letter
Read the profession entry and decide which qualification route the application relies on. If it is the diploma-plus-experience route, the diploma must be in hotel or restaurant management and the three years of experience must be in that field and documented by someone who can attest to it. Employment letters from former inns and restaurants, with dates, titles and duties, do that work; a resume does not. Settle this before the US employer drafts anything, because a letter written around a degree the applicant does not hold has to be rewritten and the inconsistency is remembered. A first review should end with a marked copy of the entry, a list of missing proof, and a single description of the role for every document. That prevents a recruiter, manager, and applicant from advancing different qualification theories.
Check citizenship, not residence
TN classification is open to citizens of Canada and Mexico. Permanent residence in Canada, however long, does not qualify anyone, and a permanent resident card offered at a port of entry answers a different question than the one being asked. Prince Edward County households often include one Canadian citizen and one partner who is not yet naturalized, so establish at the outset which member of the household can be the principal applicant under this category and whether the other has a route of their own. Record citizenship evidence separately from work history and immigration status. A passport resolves nationality; a residence card, tax return, or local address does not. Mixing those records usually wastes preparation time rather than curing eligibility.
Keep the position an employment position
The work must be prearranged professional employment with a US employer that controls it. Self-employment in the United States is not permitted under this category, so a manager who intends to invoice the resort group through her own consulting company, or who is being offered equity as part of the package, needs that examined before anything is filed. An ownership interest in the US employer should be disclosed and explained, and a controlling stake raises the self-employment problem directly rather than incidentally. Ask who directs the work, pays wages, may end the engagement, and bears the commercial risk. Put the answers beside the contract before describing the arrangement. A title cannot repair facts that point to independent business activity.
Apply where the file is strongest
A Canadian citizen may seek TN classification at a US port of entry or preclearance location with proof of citizenship, the employer's letter, the credential documents and the applicable fee, or the US employer may file Form I-129 with USCIS in advance. No visa stamp is issued for Canadians. A file that rests on the experience alternative is often better tested through an advance petition, because a refusal at the border is recorded and the applicant then has to travel again with the same documents. Pick the process only after the evidence is assembled. An advance petition may be useful where the qualification issue is technical; a travel application leaves little room to retrieve a missing record on the day of examination.
