Start with the EB-5 eligibility and application overview
Fix the capital amount and the project category
The standard investment amount is 1,050,000 US dollars, reduced to 800,000 for an investment in a targeted employment area or an infrastructure project, under the 2022 Reform and Integrity Act. Those figures are subject to adjustment, so confirm the current amounts and the current targeted-employment-area designation for the specific project before committing. Whether a project qualifies for the reduced amount is a fact about the project and its location, evidenced in its documentation, not a characterization the investor can supply. Match every deposit and withdrawal to a statement, contract, tax record, or transfer receipt. The review should identify gaps before filing, especially where a sale, loan, gift, or currency conversion supplied part of the capital.
Document the source and the path of funds
The petition must show that the capital was lawfully obtained and trace it from its origin to the investment. For a farmland sale that means the deed and sale agreement, the closing statement, evidence of how the land was originally acquired and paid for, tax records for the sale, and the bank records showing the proceeds arriving and then moving to the escrow or project account. Gaps invite questions, and a gap of years in the middle of a chain is harder to close than a missing recent statement. Build a job table that names the qualifying positions, their expected hours, and the evidence that will later show they exist. This distinguishes a business plan's broad hiring aspiration from a case that can support conditional residence removal.
Understand what engagement requires
An EB-5 investor must be engaged in the management of the enterprise through day-to-day managerial control or policy formulation. In a regional centre investment this is ordinarily satisfied by the rights held as a limited partner or member under the project's governing documents, so those documents should be read to confirm the investor actually holds them. In a direct investment the engagement is real and continuing, and the difference between the two structures matters as much to the family's daily life as to the petition. Make the family decision early because derivative eligibility is not repaired by investment success. A child nearing twenty-one, a marriage, or a separate educational plan can change whether the household pursues the route at all.
Count the family before filing
The spouse and unmarried children under twenty-one at the relevant time may be included as derivatives. A twenty-year-old unmarried daughter may be included, subject to the age calculation rules that apply; a married son of any age cannot be. Because the age question turns on dates and on how long a petition is pending, the family should identify each member's position early and take advice on the calculation rather than assuming a birthday alone decides it. Reserve time and budget for the post-approval stages. Petition approval does not itself grant residence, and the capital and job obligations continue through the two-year conditional period before the removal filing.
