THE SHORT ANSWER

Hypothetical example: the founder of a Quinte West aviation-services contractor is selling to a partner, has a spouse and a twenty-year-old son, and is weighing a regional-centre EB-5 investment against the individual Gold Card route. EB-5 requires US$1,050,000, or US$800,000 in a targeted employment area or infrastructure project, invested at risk, at least ten full-time jobs for qualifying US workers, and two-year conditional residence, with Form I-829 filed in the 90 days before the second anniversary; the Gold Card framework involves a gift to the U.S. government plus a non-refundable processing fee with the existing immigrant criteria still applied. For this family the deciding factors are the son's age and how each route treats time, and both the EB-5 amounts and Gold Card terms should be re-verified before any money moves.

01

Lay the two timelines side by side

An EB-5 case runs from capital contribution and Form I-526 or I-526E through approval, visa availability, conditional residence and the I-829 filing two years later; the capital is expected to stay invested through the job-creation period and repayment is never guaranteed. The Gold Card route, as described on the official program page, involves a processing fee at the outset and a gift instructed after vetting, with an immigrant petition under the existing EB-1 or EB-2 criteria; its timing depends on how the program handles the case and should be verified on the official page. Neither route permits the founder to work in the United States while it is pending; visits are visits.

02

Run the son's age through each route

A twenty-year-old is the fact that decides this family's sequence. In EB-5 the son may be a derivative as an unmarried child under twenty-one, and age-protection rules can freeze his age based on the petition's filing and approval dates and visa availability; filing soon is what preserves him. In the Gold Card route, the treatment of a joining child, including the per-person fee and whether the same age rules apply to the underlying immigrant petition, should be taken from the official text on the day. If neither route can be filed before his birthday, he will need a route of his own, such as a student visa, and the family should decide whether that is acceptable before choosing between the parents' routes.

03

Compare what the money does and whether it returns

EB-5 capital is an investment: it must be lawfully sourced, traced, contributed to the enterprise and left at risk, and the investor must be engaged in management or policy; a regional-centre limited partnership with policy rights can satisfy that. The Gold Card gift is a gift to the U.S. government, not an investment, and the processing fee is stated to be non-refundable; it does not purchase equity and does not by itself establish eligibility, which is assessed under the existing criteria. The founder should not treat the gift as a faster EB-5 or the EB-5 as a refundable gift. Confirm the current EB-5 amounts, the 2027 adjustment and the official Gold Card terms before any money moves, and choose the route that protects the son's status first.
