Hypothetical example: a Quinte West frozen-vegetable processor owns a co-packing plant in the United States through a common holding company. It wants to send its food-safety and sanitation manager, who has run the plant's HACCP program for six years, to take over the same function at the US plant. She has two technicians reporting to her and no supervisors beneath them, and the US plant's organizational chart lists her future position under 'quality'. Whether this is an L-1A case depends less on her title than on whether she manages an essential function at a senior level, and the record that decides it is the reconstruction of what she actually directs.

Start with the L-1A eligibility and application overview

01

Decide between people management and function management

L-1A managerial capacity can be shown in two ways. The first is managing the organization or a department through subordinate supervisors, managers or professionals, with authority over hiring and firing or recommendations on them. The second is managing an essential function at a senior level within the organization without necessarily supervising anyone. A food-safety manager with two technicians is unlikely to meet the first test, because her direct reports are not supervisors or professionals. Her case must be built on the second: that food safety is essential to a processing plant, that she sets its policy, controls its budget and answers to senior management, and that the technicians and line staff perform the routine work.

02

Reconstruct the reporting lines from records

The organizational chart the company already has is rarely the one the petition needs. Rebuild it from payroll classifications, shift schedules, corrective-action sign-offs and audit reports so that it shows who approves the HACCP plan, who trains line staff, who can hold a shipment, and who does the swabbing and record-keeping. If the manager herself performs a substantial share of the daily verification tasks, that must be described honestly and weighed; a petition that claims she is freed from routine work when the audit logs carry her initials on every page will not survive a request for evidence.

03

Prove the relationship and the foreign year

Both plants must be linked as parent, branch, subsidiary or affiliate. Two operating companies owned by the same holding company in the same proportions are affiliates, and the petition should include the holding company's share register, the two subsidiaries' registers and their financial statements. The manager must have worked for the Canadian entity for one continuous year within the three years before filing; a maternity leave, a secondment to a customer or a period on the US plant's payroll all need explaining, since time in the United States for the affiliate does not count toward the year although it does not necessarily break it.

04

Show the US role is a step up or across, not down

The US position must itself be managerial or executive. If the US plant's chart shows the transferee reporting to a quality supervisor, or shows her performing line inspections because the plant is smaller, the petition fails on the destination role even if the Canadian role qualifies. Fix the structure before filing: define the function she will own, the budget she will control, the staff who will do the routine sampling and the senior manager she will answer to. Both entities must be actively doing business at the time of filing and throughout; a US plant idle between seasons needs evidence of continuing operations.
