Who comes with you: family arithmetic in a Stirling-Rawdon investor decision

THE SHORT ANSWER

Hypothetical example: a Stirling-Rawdon couple in their fifties are considering an immigrant investment and have three children, aged seventeen, twenty and twenty-four. Before comparing costs or timelines they should work out who can actually be included, because the answer changes the decision entirely. Derivative eligibility in EB-5 is limited to a spouse and unmarried children under twenty-one. The Gold Card is a distinct official framework based on a gift to the U.S. government plus a processing fee, not an EB-5 investment; its current family terms must be read from the official materials and re-verified before any money moves. Hypothetical example: an environmental-testing company founder can fund an EB-5 project from a documented business sale or consider the Gold Card framework. The decision is whether the family needs an investor route with capital at risk, employment creation and conditional permanent residence, or is prepared for a personal payment to the U.S. government under a program that is not a conventional visa. Start with confirmed terms and the family’s actual inclusion needs.

01

Do the investor category arithmetic first

In an EB-5 case the spouse and unmarried children under twenty-one may be included as derivatives. The seventeen-year-old is comfortably within that; the twenty-year-old is within it today but the process takes time, and a statutory calculation applies that can preserve eligibility for part of the period, depending on dates the family does not control. The twenty-four-year-old is outside it regardless of circumstances, and marriage removes a child of any age. Work these facts out with exact dates before anything else, since a plan that assumes the whole family travels together may be a plan for a different family. The principal must separately invest US$1,050,000, or US$800,000 in a targeted employment area or infrastructure project, from a lawful source through a documented path; create at least ten full-time jobs for qualifying US workers; engage in management or policy formulation; and proceed through two-year conditional residence and Form I-829. For EB-5, create a dated source-and-path file before selecting a project. The project materials should explain how employment creation is counted and how capital remains deployed, while the applicant’s records explain lawful funds. Investor petition approval is not itself final residence; visa processing and conditional residence follow.

02

Read the other framework's terms rather than assuming

The Gold Card is a recent framework described on its own official page and in the establishing executive action, and its provisions for family members are whatever those materials say. Nothing from the investor category carries across automatically: not the age limit, not the derivative concept, not the treatment of married children. Where the official materials do not address a family's situation, treat it as unresolved and get it answered before any payment, since a program whose principal cost is a large irrecoverable sum is the wrong place to rely on inference. For the Gold Card framework, read only current official materials for family treatment, payment process, screening and any stated outcome. The applicant’s payment to the U.S. government should not be described as a business investment, and absent official language about a relative is an unresolved issue rather than an implied benefit.

03

Plan separately for the children who cannot be included

An adult child outside the derivative limits is not without options, but the options are their own: a student route if they will study, an employment category if they qualify, or a family-based route years later if a parent becomes a permanent resident, with its own long waiting period. Have that conversation with the child directly, early, and include the practical questions of where they will live and what the family's support looks like across a border. Families sometimes conclude that the timing is wrong and wait, and that is a legitimate answer that costs far less than discovering the arithmetic after the money has moved. Hypothetical example: a food-safety laboratory owner has a twenty-year-old unmarried daughter whose wedding is planned next year. The concrete decision is whether EB-5 timing and derivative rules can accommodate her, or whether a separate route is needed. Do not make an irreversible payment before checking dates, marital facts and current program terms.
