Start with the EB-5 eligibility and application overview
Count the jobs before committing the capital
A direct investment must create at least ten full-time positions for qualifying US workers, and full-time generally means at least thirty-five hours a week. Part-time positions cannot ordinarily be combined to make one, and the investor, spouse and children do not count. Build the staffing plan from the actual operation: how many people the line requires per shift, how many shifts, plus maintenance, logistics and administration. If the honest count is eight, the plan needs to change before the money moves, not after the conditional residence period has started running. Source-of-funds review begins with the earliest provable origin, not the wire sent to the project. Tax returns, sale agreements, payroll records, bank statements and gift or loan documentation should form an unbroken explanation. A late unexplained deposit is often more damaging than a missing decorative exhibit.
Trace the sale and the gift separately
Both the herd and quota sale and the parental gift need their own complete trail. For the sale: the agreement, the settlement statement, the buyer's payment, and the tax filings reflecting the disposition. For the gift: a signed gift instrument, evidence of the parent's own lawful source of those funds, and the transfer records. A gift is examined as closely as any other source precisely because it arrives without a transaction behind it, and the parent should expect to produce their own financial history. The investment decision turns on project structure as well as immigration eligibility. Read the offering documents, escrow provisions, repayment priorities, fees, borrower security and job-creation methodology with qualified financial advisers. Immigration approval does not remove ordinary investment risk or guarantee liquidity.
Know the amount and confirm it is current
The qualifying investment is 1,050,000 US dollars, or 800,000 where the investment is in a targeted employment area or an infrastructure project, under the 2022 Reform and Integrity Act, with those amounts subject to adjustment. Whether a particular rural or high-unemployment location qualifies as a targeted employment area is a factual determination supported by evidence, not a description the investor chooses. Verify both the current amount and the designation for the specific project before any funds are committed. Keep a calendar for both the immigrant-visa stage and the later conditional-residence stage. Conditional status is not the final benefit; the petition to remove conditions requires evidence that the capital remained deployed and the employment requirement was met or is being met under the rules. Preserve records from day one.
Be clear about engagement and the two-year period
The investor must be engaged in the enterprise through day-to-day managerial control or policy formulation, which in a direct investment means genuine involvement rather than a passive interest. Approval leads to conditional permanent residence for two years for the investor, spouse and unmarried children under twenty-one, ending with Form I-829 to remove conditions, which must show the investment was sustained and the jobs created. Plan for that filing from the first day of operations, because the payroll evidence it needs is generated continuously. Family planning must use exact dates and individual facts. A spouse and eligible unmarried children may derive benefits, but age calculations can be time-sensitive. Verify visa availability and each child’s position before committing capital, rather than relying on a project promoter’s broad assurance.
