A larger combined total cannot replace the need to establish substantial investment, control and nonmarginality.
Begin with purchase price, deposits, inventory, lease obligations, advisers, government charges, and family expenses. The first review should produce a budget separating enterprise capital from professional fees and personal relocation costs.; each conclusion should point to the record that settles it. Next, match every expenditure to its agreement, payment evidence, and business purpose. This order keeps a later explanation from being asked to repair a missing fact. Hypothetical example: A mobile-pet-grooming investor combines a truck, apartment deposit, and consultant fee in one sheet. The review separates commercial commitments from personal expenses. The decision is whether the actual record supports the proposed activity now, requires a different sequence, or calls for a separate route. E-2 requires treaty nationality, a real enterprise, and an investor who will develop and direct it. Capital must be committed in a manner that exposes it to commercial loss, and the enterprise cannot be marginal.
