Funding does not establish the spouse’s US work permission. Qualifying E spouses may be employment-authorized incident to status with the required evidence, but a pending case or escrow payment is not that status. Review the actual activities and authorization before operational work begins.
Separate the transaction from the staffing decision
Identify who is authorized to run the business during the pending period. A family ownership interest does not automatically permit management work. Keep the spouse’s intended status and documents distinct from the evidence establishing the principal’s investment.
Begin with family roles, nationality and relationship records, status plans, and any ownership allocation. The first review should produce a household activity plan distinguishing investment proof from permission to manage, work, study, or travel.; each conclusion should point to the record that settles it. Next, decide who may perform each pre-opening task before assigning relatives to operations. This order keeps a later explanation from being asked to repair a missing fact. What commonly goes wrong is a share certificate does not automatically authorize management during a pending case. Preserve dated source material and identify the unresolved issue instead of using a confident generalization. Hypothetical example: A specialty-coffee buyer wants a sibling to supervise renovations and a spouse to negotiate suppliers. The review distinguishes ownership from permission to undertake each activity. The decision is whether the actual record supports the proposed activity now, requires a different sequence, or calls for a separate route. E-2 requires treaty nationality, a real enterprise, and an investor who will develop and direct it. Capital must be committed in a manner that exposes it to commercial loss, and the enterprise cannot be marginal.
