Suppose a Belleville employee has advanced knowledge of a company process that is described partly in public technical material. The proposed US assignment relies on the employee’s deeper implementation experience. L-1B assessment should explain that knowledge under the applicable standard rather than assume that public disclosure automatically defeats the claim or that confidential language automatically proves it. Separate company information from the applicant's developed knowledge. The file should identify how that knowledge was acquired, the specific U.S. task that needs it, and records that demonstrate personal experience. L-1B likewise requires related qualifying organizations and twelve uninterrupted months of full-time foreign service in the preceding three years. Total time in this classification is generally capped at five years. The company should choose representative examples instead of a broad catalogue of technical material. For each, identify the problem, the applicant's learned method, the source record, and the U.S. task requiring that method. This allows evaluation without treating secrecy as proof. It also helps decide what can be redacted and what context must remain available. A carefully selected technical narrative can demonstrate personal experience more clearly than many pages that never connect the worker to a specific applied judgment. The company should decide which technical witness can explain the applicant's actual experience in plain terms and which records corroborate that witness. This avoids relying on a confidential label, a complex product description, or a job title when the real issue is the employee's applied organizational knowledge. Sequence the technical proof from the employee's actual learning to the U.S. task, with a named witness for each material point. That makes it easier to distinguish a credible developed capability from a generalized product description.

01

Separate publication from expertise

Identify what the public material explains and what the applicant knows through actual work. The relevant knowledge must meet the applicable special or advanced definition. Secrecy, a patent reference or a nondisclosure agreement is not a substitute for that analysis. Prepare a knowledge map connecting the product or process, the applicant's developed expertise, its application, and the evidence source. Public material may give context without deciding what the employee knows.

02

Show application and depth

Use project records and supported explanations of the employee’s responsibilities and decisions. A person can read a description without having the same implementation expertise, but the case needs evidence of the applicant’s actual knowledge rather than an assertion of superiority. Training records, troubleshooting histories, and supervisor accounts can establish practical learning better than a résumé alone. The record must explain the applicant's own role.

03

Connect the proposed work

Describe the US tasks that require the knowledge and the applicant’s intended role. The assignment should not be generic duties presented as specialized merely because the employer publishes technical papers. Review the real work and supporting organization. Translate the U.S. assignment into concrete decisions and work products. Generic implementation cannot become specialized merely because the company uses technical language.

04

Establish the transfer requirements

Document the qualifying company relationship and required foreign employment. Specialized knowledge need not be unique worldwide, and a labour-market search is not the governing test. The full classification requirements still apply. Both entities must remain active. An offsite client placement must not be labour-for-hire and must remain controlled and supervised by the petitioner. A new-office petition is initially limited to one year and requires sufficient premises and capacity to support the role. Confirm ownership, control, and foreign employment before relying on technical exhibits. Sensitive material may be protected, but it must retain enough context to be intelligible.
