Form the enterprise, contribute or irrevocably commit the full capital, document the source and path, then file Form I-526 with a business plan showing how ten full-time jobs will be created; hiring can continue after filing but must be complete, or on a credible schedule to complete, by the time conditions are removed. Management of the shop in person requires status, so plan the move around visa availability.
Capital first, petition second, payroll on schedule
The sequence is set by the rules on when capital must be invested and when jobs must exist. Step one is forming the US enterprise and opening its accounts. Step two is moving the capital in, or placing it in an arrangement from which it will pass to the enterprise on the sole condition of petition approval, while keeping the trail clean.
Step three is the business plan: a credible, detailed plan with a hiring schedule that reaches ten qualifying full-time positions. Step four is filing the I-526 with the source-of-funds evidence. After approval and when a visa number is available, the family completes consular processing or adjustment and receives two-year conditional residence; in the ninety days before the second anniversary they file the I-829 showing the capital remained invested and the jobs were created.
Between filing and residence, the investor may visit the United States to attend to the business as a visitor, but running the shop day-to-day from US soil requires status of his own.
