Your talent.A bigger stage.

Hypothetical example: a Belleville resident receives a US professional offer with conditions involving credentials and permission to practise. TN requires Canadian or Mexican citizenship, a prearranged role in a listed profession, and that profession’s own qualifications. U.S. self-employment is not permitted, and any ownership stake must be disclosed. A Canadian citizen may apply at a port of entry or through Form I-129 and generally does not need a TN visa stamp. State licensing remains a separate issue. Use a duty-and-qualification grid rather than a broad job title. It should identify the exact listed profession, the credential alternative selected, the real employer, and the work that would occur before any licence is issued. TN requires eligible Canadian or Mexican citizenship and a listed professional category. A Canadian may seek admission on arrival or through preclearance, while an employer may submit an I-129 to USCIS. It cannot be structured as self-employment through a U.S. enterprise the worker owns or controls. A practical decision memo should state the proposed profession, the qualifying record, the exact services, the employer who controls the work, and any separate regulator condition. It should identify who signs the letter and who can explain the business need. This prevents a later attempt to cure a vague role description with a résumé that proves education but not requested services. If the job changes, revisit the classification before the professional performs changed work. The record should preserve the real sequence rather than creating a retrospective explanation for an already-started assignment. Before finalizing a TN case, compare the signed letter, the selected profession, and the day-one work schedule word for word. The employer must decide whether a conditional start, a revised scope of duties, or a different hiring sequence is needed. A clear answer protects both the applicant and the business from treating a future authorization or licence as an existing fact.

01

Identify the listed profession

Compare the actual position with the relevant USMCA profession and its exact qualification alternatives. A broad job title is not enough. Establish eligible Canadian or Mexican citizenship; a Canadian PR card does not satisfy that requirement. The first review produces a matrix that assigns every duty to an immigration requirement, a professional rule, or an employer condition. This exposes a mismatch before the employer letter is drafted.

02

Separate three kinds of conditions

Record what the immigration category requires, what the applicable professional regulator requires and what the employer requires. Some evidence may serve more than one purpose, but the standards should not be treated as identical. Obtain the actual requirements before ordering services. Collect the issuing record before purchasing optional analysis. A transcript, licence verification, or signed duty description can settle a point that a generic checklist leaves unresolved.

03

Explain the intended duties

If the role will change after licensing, describe the stages accurately and assess whether the proposed arrangement supports the category. Do not disguise unlicensed professional practice as training or claim a credential the applicant has not received. If a credential remains pending, distinguish lawful preparation from regulated practice. An interim label does not make the underlying activities permissible.

04

Coordinate the lawful start

The applicant needs appropriate immigration permission and any other authorization required for the work actually performed. A conditional offer is not itself work authorization. TN does not permit U.S. self-employment, and every ownership stake must be disclosed and assessed. A Canadian citizen may seek TN admission at a port of entry, or a U.S. employer may file Form I-129; the Canadian citizen does not need a TN visa stamp. Set a start-date contingency after identifying the admission or petition procedure and the evidence owner. Preserve the real assignment sequence if duties or worksite change.
